Right of withdrawal

- In accordance with art. 52 of the Consumer Code, the Customer has the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason, within 14 (fourteen) days from:
- for Products (goods) purchased on the Site, from the day of receipt by the Customer;
- for services (for example: Discount Coupon Codes), from the day of conclusion of the contract, i.e. from the sending of the Customer's order to the Seller's systems and subsequent digital delivery of the service.
The right of withdrawal is correctly exercised within the withdrawal period referred to in Article 52, paragraph 2, and Article 53 of the Consumer Code if the communication relating to the exercise of the right of withdrawal is sent by the Customer before the withdrawal period expires.
- Pursuant to Article 54 of the Consumer Code, the Customer may withdraw from the contract concluded with the Seller using, at his/her discretion, one of the following methods:
- follow the instructions on the How to request a return page, which distinguishes between orders placed as a registered user (with an account) and orders placed as a guest user (without an account);
- send the Seller, by post or email, to the addresses above, an explicit declaration of exercise of the right to withdraw from the contract, possibly adopting the standard form in Annex 1, letter B of the Consumer Code.
Upon receipt of the withdrawal declaration, the Seller will promptly communicate to the Customer, via email, a confirmation of receipt of the withdrawal exercised, which will be followed, following verification, by a further email accepting or rejecting the withdrawal, depending on whether or not the methods and terms for exercising this right indicated below have been complied with.
- Pursuant to Article 57 of the Consumer Code, once the right of withdrawal has been exercised, the Customer is required to return the Products by shipping them to the Seller (Maurizio Abbigliamento Srl, Via Provinciale Est 18 - 40053 - Valsamoggia, Loc. Bazzano (BO) – Italy) or by delivering them to a physical store specifically indicated by the Seller, without undue delay and in any case within 14 (fourteen) days from the date on which the Customer communicated his/her decision to withdraw from the contract to the Seller. The deadline is met if the Customer returns the Products before the 14 (fourteen) day period expires. The costs of returning the Products to the Seller are entirely borne by the Customer, as is the Customer's responsibility in the event of loss or damage to the Products during transport, whether due to negligent choice of the courier responsible for the shipment and/or the shipping method. We therefore recommend using highly reliable couriers and using shipping methods with tracking.
- In addition to the terms and conditions described in the previous points 1.1, 1.2 and 1.3, the right of withdrawal is considered correctly exercised if the following conditions are also fully respected:
- the Products must not have been used, worn, washed;
- The Products are delivered to the Customer with a disposable identification tag: it must still be present, well preserved and, in the case of disposable seals, attached in its original position;
- the Products must be returned in their original packaging, if it is disposable it must not have been opened and must still be well sealed;
- the Products must still have all the original labels, packaging and accessories (dust bags, hangers, garment covers, etc.) received with the order;
- Swimwear and underwear (bikinis, briefs, boxers, etc.) may be tried on by the Customer over their own underwear, but must not show signs of use, nor may the transparent hygiene protection label be removed;
- the Products must not be damaged;
- the Products must be delivered to the courier responsible for shipping, or delivered directly to a physical store indicated by the Seller, within 14 (fourteen) days from the communication to the Seller of withdrawal from the contract;
- In the case of Products shipped from a country outside the European Union, import duties and taxes in Italy must be paid in advance by the Customer.
- Pursuant to Article 59 of the Consumer Code, the right of withdrawal is also excluded if the Customer has purchased custom-made or personalized Products, or sealed Products that are not suitable for return for hygiene or health protection reasons and that were opened after delivery.
- If, following adequate verification by the Seller, the right of withdrawal has been exercised following the methods and terms indicated above, the Seller will send the Customer, via email, acceptance of the withdrawal and of the returned Products and, subsequently, will refund the price already paid, excluding any import taxes, customs duties and any other amount not included in the sale price, as quickly as possible and, in any case, within 14 (fourteen) days from the date on which the Seller became aware of the exercise of the right of withdrawal, unless the Seller has not yet received the Products from the Customer or until the latter has demonstrated that he has returned the Products, depending on which situation occurs first.
- Please note that, in the event of a Product return by delivery to a physical store indicated by the Seller, receipt of the Product by staff does not constitute acceptance of the withdrawal exercised, nor, therefore, will any refund be issued at that location and time. Verification of the correctness of the exercise of this right will be carried out subsequently, and by different specialized personnel, compared to any receipt of the Product at the physical store.
- In case of refund, the Customer can choose between two different methods, to be communicated to the Seller in response to the email accepting the withdrawal exercised:
- Voucher: The Customer will be sent a discount code corresponding to the price of the returned Products, net of any import taxes, customs duties, and any other amounts not included in the sale price. This Voucher may be used within 90 (ninety) days of issue in a single transaction for an order with a value equal to or greater than the refund;
- Payment Refund: For orders paid by PayPal, Amazon Pay, Apple Pay, Klarna, or Credit Card, the refund, net of any import taxes, customs duties, and any other amounts not included in the sale price, will be made to the original payment account/Credit Card, according to timeframes over which the Seller has no control, as these procedures are the exclusive responsibility of PayPal, Amazon Pay, Apple Pay, Klarna, or the credit card issuing bank. For payments by bank transfer, SOFORT Banking, or iDEAL, the amount will be refunded to the original bank account. Processing times may vary depending on the bank, and it may take up to 5-6 business days from the time the refund is made for the amount to be credited to the customer's bank account. In the case of cash on delivery (COD) payment, the refund will be made via bank transfer. To do so, the Customer must provide a valid IBAN corresponding to a valid bank account in their name, as well as the order number. In any case, the refund will deduct the amount corresponding to the bank fees incurred by the Seller for the transfer.
- If the Customer fails to comply with the terms and conditions for exercising the right of withdrawal set forth in points 1.2, 1.3, and 1.4, they will not be entitled to a refund of the sums already paid to the Seller, who will communicate via email that the return has not been accepted. In this case, within 14 (fourteen) days of receiving the Seller's email, the Customer may request to receive the Products again, at their own expense, in the condition in which they were returned to the Seller. If the Customer refuses, the Seller may retain the Products, in addition to the price already paid for their purchase.
- In any case, the Seller cannot be held responsible for:
- any delays in the refund attributable to the Customer (where he/she has not communicated refund preferences and/or has communicated incorrect details), banks, payment circuits and/or third parties;
- Products returned by mistake, or damaged or not returned due to the carrier's responsibility or attributable to third parties.
- By exercising the right of withdrawal, the Customer is not entitled to any exchange (size, color, article, etc.) of Products.
