General conditions of sale

Premise
The offer and sale of products on the website of Maurizio Abbigliamento Srl (hereinafter, the “ Seller ”), reachable at the URLs: www.mauriziocollectionstore.com , www.mauriziocollectionstore.it , www.mauriziocollection.com , www.mauriziocollection.it (hereinafter, the “ Site ”), are governed by these General Conditions of Sale (“ GTC ”).
The GTC govern exclusively the submission of purchase orders for products offered on the Site by the consumer user and their acceptance by the Seller. Services or sales performed by third parties that may be referenced on the Site via links or banners are excluded, for which the Seller assumes no responsibility.
1. Trade policy
1.1 The products (hereinafter, “ Products ”) are sold by Maurizio Abbigliamento Srl , with registered office in Via Gandolfi n. 6, Valsamoggia, Loc. Bazzano (BO) – Italy , CF/P. IVA 02885711206 , REA: BO – 475051 , exclusively to the final consumer (a natural person acting for purposes outside of any entrepreneurial, commercial, artisanal or professional activity carried out).
1.2 If you are not a final consumer, please do not make purchases on the Site.
1.3 Orders and returns must comply with normal consumer requirements . The Seller may refuse orders that do not comply with these conditions or these GTC, notifying the user accordingly.
1.4 Payments and refunds : payments, refunds and monetary transactions resulting from purchases or returns are received, sent and processed by Sugo Snc di Federico Sacchi e Cristian Antolini (“Sugo Solutions”, www.sugosolutions.com), with registered office in Via Matteotti n. 154, 40014 Crevalcore (BO) – Italy , CF/P. IVA 03269341206 , REA: BO – 505415 , which collects payments in the name and on behalf of the Seller, on behalf of the management of the Site, related services and monetary transactions.
2. Customer requirements
To place orders on the Site, the user declares to:

be the final consumer ;

be at least 18 years old ;

have a valid email address ;

have the capacity to enter into legally binding contracts.
3. Purchase procedure
3.1 Purchases can be made with or without registering an account. Registration is free.
3.2 To purchase: select the Product (and any size/variant) and click "Add to cart" . The cart stores the Products until the order is completed but does not guarantee availability : the Products remain available for purchase by other users until payment is completed.
3.3 You can view your cart and proceed to checkout at any time. Prices are shown in Euros , including VAT where applicable; shipping costs are shown and updated during checkout. If the destination is outside the EU , the total is shown without VAT .
3.4 At checkout the user will be able to:

3.6 By ticking the acceptance boxes and clicking on “Pay now/Complete order” , the user sends an order proposal to the Seller in accordance with these GTC.
4. Conclusion of the contract
4.1 Pursuant to Legislative Decree 70/2003, sending the order proposal implies knowledge and full acceptance of the GTC .
4.2 Receipt of the order proposal is automatically confirmed by email (e.g., " Order confirmation "). This message does not constitute acceptance.
4.3 The Seller reserves the right to verify the availability of the Products and the details of previous orders. In the event of unavailability or impediments, the user will be notified by email and the contract will not be concluded (with possible refund of the amount paid).
4.4 The sales contract is considered concluded only when the Customer receives an acceptance and/or shipping email (e.g., " Order Summary " or shipping notification). Only the Products indicated in this communication are included in the contract.
4.5 In the case of advance bank transfer , the contract is considered concluded upon receipt of the acceptance email containing the bank details. Shipping will take place after the payment has been credited .
4.6 The contract is subject to the termination condition of non-payment : in default, the order will be cancelled and the Customer notified via email, with a refund of any sums already paid according to the payment method used (see §10).
5. Products, prices and availability
5.1 The Products available for purchase are those present in the online catalogue at the time of ordering. Each Product sheet lists essential characteristics, price , and availability .
5.2 Prices are in Euros , including VAT where applicable. Shipping and taxes are indicated at checkout before payment. Prices may vary; the price shown in the order summary before sending is the reference price.
5.3 Despite ongoing updates, there may be temporary unavailability for simultaneous online/offline orders. In this case, the Customer will be notified and may obtain a refund/partial fulfillment.
6. Warranties
6.1 The Products are sold by Maurizio Abbigliamento Srl , an authorized reseller of selected brands.
6.2 Screen images may not reproduce colors and details perfectly due to the device, browser or web standards.
6.3 The Products are covered by a 24-month legal guarantee of conformity . The defect must be reported within 2 months of discovery (registered mail, certified email, or email to support@mauriziocollectionstore.com ). The Customer has the right to repair or replacement ; if impossible or excessively costly, to a price reduction or termination (Article 130 of the Consumer Code).

7. Payments
7.1 Payment methods activated on the Site may include, depending on the country and Shopify settings: credit/debit cards (Visa, MasterCard, American Express), Shop Pay , PayPal , Apple Pay , Google Pay , Klarna (payment in 3 installments where available), advance bank transfer , and cash on delivery (COD) for orders in Italy if enabled. No costs exceeding those incurred by the Seller for the chosen method will be charged. The Seller may suspend/limit payment methods at any time.
7.2 As per §1.4, payments and refunds are processed by Sugo Snc in the name and on behalf of the Seller. The sales document/invoice is issued by the Seller.
7.3 Cards / Shop Pay / PayPal / Apple Pay / Google Pay / Klarna : Payment is generally made upon acceptance of the order (conclusion of the contract). Payment data is processed by the respective providers over a secure connection ; the Seller does not store card data.
7.4 Advance bank transfer : the bank details will be provided in the acceptance email. Please indicate the order number in the reason for payment. The order may be cancelled if proof of payment is not sent promptly or if the payment is not received within the indicated timeframe. Shipping will begin after the payment has been received .
7.5 Cash on delivery (if available) : valid only for deliveries in Italy, up to the maximum amount indicated at checkout. A service fee may apply. Payment is made in cash to the courier. The service fee is non-refundable .
8. Discount codes
8.1 The Seller may issue personal, non-transferable discount codes , which will be communicated to interested users.
8.2 Offers may not be cumulative and/or may have minimum thresholds or exclusions for certain brands or categories. The specific conditions are indicated at the time of issue.
8.3 Enter the code in the "Discount Code/Gift Card" field at checkout; the total will be recalculated.
9. Shipping, duties and delivery
9.1 Shipping is subject to a charge unless otherwise indicated; the amount is shown at checkout and in the order summary. Shipping methods and costs are always available on the "Shipping Times and Costs" page.
9.2 Shipments via tracked couriers ; upon shipment, the Customer receives an email with tracking information . Deliveries are made within working days.
9.3 Extra-EU : unless otherwise indicated, shipments are made DAP (Delivered At Place – Incoterms 2020) : duties, customs charges, import and local taxes are the responsibility of the recipient .
9.4 Failure to deliver due to unavailability/incorrect address attributable to the Customer: the order may be returned to the warehouse; the contract may be automatically terminated with a refund of the price net of failed shipment, inventory, returns, and costs incurred.
9.5 Check upon delivery: if the package is damaged/tampered with , sign with specific reservations (e.g., "damaged package") or refuse. Signing without reservations limits your rights against the courier, except in cases of hidden damage reported within 8 days .
9.6 EU Customers : Sales and deliveries in Italy/EU do not involve import duties.
EU countries (updated list): Austria, Belgium, Bulgaria, Croatia, Cyprus, Czechia , Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia , Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania , Slovakia, Slovenia, Spain, Sweden.
9.7 The Customer must report any special delivery requirements ; additional costs for failure to report or incorrect reporting will be borne by the Customer.
10. Right of withdrawal (distance purchases)
10.1 The Customer has the right to withdraw without penalties within 14 days :

for goods , from the day of receipt ;
-
for any digital services , from the day of conclusion of the contract .
10.2 Methods of exercise (art. 54 Consumer Code):

the Customer can initiate the return request independently by accessing the Order Status page received via email or by entering their customer account on the Site and selecting the “Request return” option;

or send the Seller an explicit declaration (by post or email) of withdrawal, also using the standard form in Annex 1, letter B of the Consumer Code.
10.3 Following the request, the Seller will send confirmation of receipt and, after checks, acceptance or rejection of the withdrawal with related instructions.
10.4 Returns (Article 57): Products must be shipped to Maurizio Abbigliamento Srl, Via Provinciale Est 18, 40053 Valsamoggia, Loc. Bazzano (BO) – Italy (or delivered to the indicated address) within 14 days of the withdrawal notification. Return costs and risks are the responsibility of the Customer.
10.5 Condition of goods:

unused/worn/washed;
-
with tags/seals intact;
-
in the original packaging (if single-use, unopened);
-
with labels and accessories (dust bags, hangers, etc.);
-
beachwear/underwear only tried on over your own underwear, with hygienic protection intact;
-
undamaged;
-
shipped within 14 days ;
-
For returns from non-EU countries, import duties and taxes in Italy must be paid in advance by the Customer.
10.6 Exclusions (art. 59): personalized/made-to-measure goods, sealed goods not suitable for return for hygiene reasons once opened.
10.7 Refunds : if the withdrawal is valid, the Seller will refund the price paid (net of duties/taxes not included in the sale price) within 14 days of knowing about the withdrawal, and may withhold the refund until receipt of the goods or proof of shipment.
Options:

Voucher equal to the price of the returned goods (net of extra charges), spendable within 90 days in a single solution;
-
Refund to the original method (Cards/PayPal/Shop Pay/Apple Pay/Google Pay/Klarna: times depending on the provider; Bank transfer/SOFORT/iDEAL: bank times; Cash on delivery: bank transfer to the customer's IBAN, with deduction of any bank fees incurred).
10.8 In case of non-compliance with the terms/procedures, the return may be refused ; the Customer may request the return of the goods at his own expense within 14 days.
10.9 No exchange (size/color/model) is possible upon withdrawal, unless otherwise indicated on the Site.
11. Non-compliant products
11.1 If the Product is non-compliant , faulty or defective , the Customer is entitled to the remedies set out in art. 130 (repair/replacement; alternatively, reduction/termination), subject to evaluation by the Seller and, if necessary, by the manufacturer .
11.2 Returns follow the procedure on the " How to request a return " page. Shipping costs are the responsibility of the Customer unless otherwise provided by law; the Seller may request photographic evidence before authorizing the return.
11.3 Defects resulting from improper use/maintenance or damage attributable to the Customer are excluded from the warranty.
12. Personal data

13. Applicable law and competent court
The GTC are governed by Italian law (Civil Code, Consumer Code, Legislative Decree 70/2003).
EU ODR platform: http://ec.europa.eu/odr .
For disputes relating to purchases on the Site/GTC, the competent court is the consumer's court (domicile/residence) or, at the consumer's choice, the Court of Bologna .
14. Modification of the GTC
These GTC may be modified unilaterally by the Seller at any time and are effective from the date of publication on the Website .
